By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

About the Service

Soundcheck, provided by Summit Logic, offers an SMS lesson reminder service for providers. The Service lets providers manage lessons, maintain students, and send SMS reminders to consenting recipients.

Eligibility and Accounts

• You must be legally able to form a contract to use the Service.
• You are responsible for your account credentials and all activity under your account.
• You agree to provide accurate information and keep it updated.

SMS Program Terms

The Service sends SMS reminders and related notifications to students who have provided consent. Message frequency varies based on scheduled lessons and provider settings.

• Opt out at any time by replying STOP.
• For help, reply HELP.
• Message and data rates may apply.
• Wireless carriers are not liable for delayed or undelivered messages.

Consent and Compliance

• Providers must obtain express consent before sending SMS messages.
• You may only send messages to students who have opted in.
• You are responsible for complying with all applicable laws and regulations.

Acceptable Use

You agree not to:

• Use the Service for unlawful, deceptive, or abusive messaging.
• Send spam or messages to individuals without consent.
• Attempt to disrupt or compromise the Service or its security.
• Reverse engineer or misuse the Service.

Billing

Paid plans, if offered, are billed in advance through our payment processor (Stripe) at the rates displayed at checkout. Subscriptions renew automatically until canceled. You can cancel from the Billing page; your plan remains active through the end of the current billing period. Fees are non-refundable, and we do not offer prorated refunds, except as required by law.

Third-Party Services

The Service relies on third-party providers for SMS delivery, payments, and hosting. Your use of those services may be subject to their terms and policies.

Content and Data

You retain ownership of your data. You grant us a limited license to host, process, and transmit that data solely to provide and improve the Service.

Availability and Disclaimers

The Service is provided "as is" without warranties of any kind. SMS delivery is not guaranteed and may be delayed or fail due to carrier issues or other factors. The Service is not intended for emergency communications.

Limitation of Liability

To the maximum extent permitted by law, Summit Logic will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Indemnification

You agree to indemnify and hold Summit Logic harmless from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

Termination

We may suspend or terminate access to the Service if you violate these Terms or if required to protect the Service or other users. You may stop using the Service at any time.

Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a new "Last updated" date.

Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of laws principles.
